Terms of use
The short version
- Alalap is for keeping short voice memories. You own what you record; you let us store and show it the way you choose (private or public).
- Be kind. No harassment, hate, sexual content involving minors, threats, spam, or recording people who haven't agreed to it.
- Anyone can report a memory or block a person. We review reports and remove what breaks these rules, normally within 24 hours.
- You must be old enough (see section 2). You can delete your account any time in Settings.
1. Who we are and what these terms cover
These terms are an agreement between you and CONFIRM: legal name, legal form and registered address of the operator ("Alalap", "we", "us"). They cover the Alalap iPhone app and the website at getalalap.com (the "Service"). By creating an account or tapping "continue" on the sign-in screen you accept these terms and our Privacy policy. If you don't accept them, please don't use the Service.
2. Who can use Alalap
- You must be at least CONFIRM: 16 (recommended; 13 is the legal floor in many countries but 16 applies in several EU countries) years old, and old enough in your country to agree to these terms.
- If we learn that an account belongs to someone under that age, we will delete it.
- You must give accurate sign-in details, keep your account secure, and tell us if you think someone else is using it. You are responsible for what happens under your account.
- One person, one account. Don't create accounts to get around a block or a ban.
3. Your content
"Content" means everything you put into Alalap: voice recordings, photos, captions, place names and locations, your username, display name and profile photo, tags and reports.
- You keep ownership. We don't claim your content.
- Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, transmit, play and display your content, and to make technical copies (for example resized photos), only as needed to run and improve the Service for you and for the people you choose to share with. This licence ends when you delete the content or your account, apart from short-lived backups described in the Privacy policy.
- Who sees it. A public memory can be seen, heard and found on the map by other Alalap users. A private memory is visible to you and to people you tag in it. New memories are public unless you change the default in Settings. Check the switch before you save.
- Other users' content. You may listen to and view public content inside the app. You may not copy, scrape, republish or sell it, or use it to train machine-learning models, without the author's permission.
- Sharing out of the app. When you share a memory to another app, you decide who receives it. We aren't responsible for what recipients do with it.
- You promise that you own your content or have the right to post it, and that it doesn't break the law or anyone else's rights.
4. Recording other people
Alalap records sound. In many places it is illegal or unfair to record someone's voice, or to publish it, without their agreement. Only record and publish voices, faces and conversations when the people involved know and agree, or when the law clearly allows it. Don't record in places where recording is prohibited (for example private homes, changing rooms, toilets, medical settings or court rooms). If someone asks you to take down a memory of them, please do.
5. Community rules
There is no place in Alalap for objectionable content or abusive behaviour. You agree not to post or do any of the following:
- sexual content involving minors, or any sexualised content of a person who has not agreed to it. We report child-safety material to the authorities;
- pornography or sexually explicit content;
- threats, harassment, bullying, stalking, doxxing, or sharing someone's private information (including exact home addresses);
- hate speech, or content that attacks people for their race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation or age;
- graphic violence, content that promotes self-harm, terrorism or criminal activity;
- impersonation, misleading identity, scams, or spam (unrequested promotions, repeated or mass tagging and following);
- content that infringes copyright, trademarks or other rights, including music or recordings you don't have the right to share;
- attempts to break, overload, reverse-engineer or gain unauthorised access to the Service or to other people's accounts, or to circumvent a block, a ban or any privacy setting;
- using the Service for anything illegal.
6. Reporting, blocking and moderation
- Report. On any memory that belongs to someone else, open the share sheet and tap "Report this memory". You can also write to safety@getalalap.com.
- Block. On a person's page, tap the "…" button and choose "Block". You and the blocked person will no longer see each other's memories or profile, and any follows between you are removed. You can undo a block any time in Settings, under "Blocked people".
- What we do. We review reports and act on content that breaks these terms, normally within 24 hours and sooner for serious cases. We may remove content, hide it, warn the person, suspend or end their account, and where the law requires or a life may be at risk, tell the authorities. We don't promise to review every piece of content in advance, and we aren't obliged to host content that breaks these terms.
- Appeal. If we remove your content or your account and you think we got it wrong, write to safety@getalalap.com within 6 months with the details and we will look again.
- Notices. If you are in the EU, the point of contact for authorities and for notices under the Digital Services Act is safety@getalalap.com. Copyright owners can send a notice there too: please include what the work is, where the content is in Alalap, your contact details, and a statement that you are the owner or authorised to act for them.
7. Your account, and ending it
- By you. You can delete your account any time in Settings, then "Delete account". It takes effect at once and removes your memories, recordings, photos and profile as described in the Privacy policy. You can first download a copy with "Download my data".
- By us. We may suspend or end your account, or remove content, if you seriously or repeatedly break these terms, if the law requires it, or if your account puts others at risk. Where we reasonably can, we will tell you why. We may also stop offering the Service, in which case we will give you reasonable notice and a chance to download your data.
8. Using the app
- Alalap is free to use. If we ever add paid features we will tell you the price and how to cancel before you pay, and the payment will go through Apple, whose rules apply.
- Normal data charges from your mobile provider may apply. SMS verification messages are sent to the number you give us.
- Maps and location depend on your device, GPS and network, and may be inaccurate. Don't rely on Alalap for navigation or in an emergency.
- Be careful about sharing your location. Public memories with a place tag tell others where you were. You can turn the tag off for each memory.
- We give you a personal, non-transferable, revocable licence to use the app on Apple devices that you own or control, in line with these terms and the Apple Media Services Terms and Usage Rules. The app contains open-source and licensed components listed in the app's licences, which keep their own licences.
- You may not copy, modify, sell, sub-license, decompile or reverse-engineer the app, except where the law says you can.
9. Our rights
The app, its design, the name Alalap and the logo belong to us or our licensors. Nothing in these terms transfers them to you. If you send us ideas or feedback, we may use them without owing you anything.
10. Service changes and availability
We work to keep Alalap available, but we can't promise it will always be uninterrupted or error-free. We may change, add or remove features, and we may update these terms (see section 14). Back up anything you can't lose with "Download my data".
11. Disclaimers and liability
- The Service is provided "as is" and "as available". To the extent the law allows, we give no warranties about it, including fitness for a particular purpose or that content from other users is accurate or safe. We don't control and aren't responsible for what other users post, though we act on reports as described above.
- To the extent the law allows, we aren't liable for indirect or consequential losses, lost profits or lost data, and our total liability to you for anything connected with the Service is limited to CONFIRM: EUR 100 / the amount you paid in the last 12 months.
- Nothing here limits liability that cannot legally be limited (for example for death or personal injury caused by negligence, fraud, or intent), or consumer rights you have by law that cannot be waived.
12. Apple
These terms are between you and us, not Apple. If you use the app on an Apple device, you also acknowledge that:
- Apple has no obligation to provide maintenance or support for the app. We are responsible for support, which you can reach at getalalap.com/support.
- If the app fails to meet a warranty that applies, you may tell Apple, who may refund the purchase price (if any); Apple has no other warranty obligation for the app. Other claims, losses or costs about the app are our responsibility, not Apple's, to the extent allowed by law. That includes product liability, legal or regulatory compliance, consumer-protection claims and intellectual-property claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you once you accept them.
- You confirm that you are not in a country under a US government embargo or on a US list of prohibited or restricted parties.
13. Law and disputes
These terms are governed by the law of CONFIRM: country of the operator, e.g. Ireland / the Netherlands, and its courts have jurisdiction, but if you are a consumer you keep the protection of the mandatory laws of the country where you live and may bring a case in your home courts. If you are in the EU you can also use the European Commission's online dispute resolution platform. We'd like to hear from you first: write to hello@getalalap.com and we'll try to sort it out.
14. Changes to these terms
If we change these terms in a way that matters, we'll update the date above and tell you in the app before the change takes effect. If you keep using Alalap after that, you accept the new terms. If you don't, you can delete your account.
15. General
If part of these terms turns out to be unenforceable, the rest stays in force. If we don't enforce a right straight away, we haven't given it up. You may not transfer your account or rights under these terms to someone else; we may transfer ours as part of a merger or sale, and will tell you if that happens.
